Fee for Full or Partial Cancellation after Signature of Contract
If the Patron partially or fully cancels the Event, the Hotel shall have suffered damages equivalent to the lost revenue that the Hotel would have earned from the sale of rooms, food and beverages, and use of recreation facilities, etc. in connection with the Event. The parties acknowledge that it is difficult to quantify damages and have agreed that the Hotel shall assess a cancellation or attrition fee (the Cancellation Fee) against the Patron as damages and not as a penalty. The parties agree that the Cancellation Fee will be calculated as a percentage of Lost Revenue (as defined below) in accordance with the following scale:
Number of Days Prior to the Event Percentage of Lost Revenue
0-30 days 100%
31-60 days 70%
61-90 days 50%
91 days or more 30%
Lost Revenue is defined as the sum total of anticipated revenue prior to the attrition and/or cancellation, from food and beverage functions and recreation facilities commitments, calculated as £5,166.80 + VAT.
The Patron is permitted an attrition allowance of up to 20% of anticipated revenue from the food & beverage, and use of recreational facilities committed to on the Option Date, up to and including 31 days prior to the Event without being assessed a Cancellation Fee in accordance with the above scale provided the Event is not fully cancelled.
Should the Patron partially or fully cancel this Event, the Hotel agrees to undertake reasonable sales efforts to resell the cancelled food & beverage and recreation facilities after first selling remaining inventory, which had been set aside for the Patron as of the Option Date.
Notice of any cancellation must be received by the Hotel in writing, and any Cancellation Fee assessed is payable by the Patron no later than thirty (30) days after being invoiced therefore by the Hotel. The Deposit amount will be deducted from any Cancellation Fee owed.
